Abstract

The rapid expansion of the Islamic economic and financial industry has not always been matched by a clear public understanding of fiqh muamalah, the branch of Islamic jurisprudence that governs worldly transactions among human beings. This study addresses three research questions: (1) how is fiqh muamalah defined by classical and contemporary jurists; (2) what position does fiqh muamalah occupy within the broader structure of Islamic law (sharia); and (3) what are its distinctive characteristics and scope. Using a qualitative library research method with a descriptive-analytical approach, this study examines classical fiqh literature, contemporary jurisprudential works, and relevant journal articles. The findings show that fiqh muamalah is the discipline of practical rulings derived from detailed evidence that regulates human interaction in property, contracts, and social-economic dealings. Structurally, fiqh muamalah occupies a complementary position alongside ibadah within the fiqh dimension of sharia, representing the horizontal (hablum minannas) counterpart to ibadah's vertical (hablum minallah) orientation, while remaining anchored in aqidah and akhlaq. Its distinguishing characteristics include the principle of original permissibility (al-ibahah), flexibility (murunah) in response to changing circumstances, orientation toward maslahah (public benefit), and firm prohibitions of riba, gharar, maysir, and injustice. Its scope extends from a narrow sense limited to commercial and financial contracts to a broader sense encompassing family law, criminal law, and public administration. These findings contribute to clarifying the conceptual foundation needed for the sound practice and further development of contemporary Islamic economics
